TFP Contract 

Model, in the interest of gaining valuable modeling experience and in exchange for modeling services, does hereby irrevocably authorize MurrayMemories.com to use photographs taken on the shoot date and any derivative works based thereupon (collectively hereafter known as the "Photos") for all lawful purposes subject to the terms and conditions described herein. This agreement shall govern the images taken on the shoot date.

Compensation for the Photo Shoot

The Model and Photographer agree to the following compensation for the photo shoot: A Minimum of 6 High resolution, edited, watermarked images and edited high resolution un-water marked images for Models portfolio union request. Model hereby grants to MurrayMemories.com and it’s assigns exclusive rights and privileges to the use of these images as they see fit.

Photographer’s Rights and Usage of Images

The Model authorizes MurrayMemories.com and it’s assigns to use the above referenced images or likeness of model derived from these images for any purposes related to the promotion of MurrayMemories.com, including but not limited to advertising, portfolios, composite cards, exhibitions, contests, and promotional internet web sites.

Model’s Rights and Usage of Images

The Model herby recognizes MurrayMemories.com as the sole and exclusive copyright holder of the Trade Compensated Photos. The Model shall affix MurrayMemories.com photo credit with all social media publication. Any images reproduced and given to the Model is governed by an indefinite license for non- commercial, self-promotional use only, these images may not be sold by the model. The model may not alter the images in any way, no crop, no filter, removal of water mark or any other method. 

Liability Release

Model hereby releases and agrees to hold harmless MurrayMemories.com and those acting under they're permission, from any liability by virtue of blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of the pictures, or in any processing tending toward the completion of the finished product. Model agrees to hold harmless MurrayMemories.com and it’s assignee for any and all damages alleged or actual for any and all uses of the images produced in this shoot.

Property Release

The Model hereby irrevocably consents to and authorizes the use and reproduction by MurrayMemories.com or anyone authorized by MurrayMemories.com, of any and all photographs which MurrayMemories.com and the Photographer has this day taken of the Model, negative or positive, mechanical or electronic, for any purpose whatsoever, and without restriction. Model waives any rights to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. 

Free Will and Consent

Model hereby affirms that all poses, positions and situations enacted in the photos covered in this release were entered into without force, coercion, or threat whatsoever, and were posed freely by Model with Model's full consent. Model further agrees to hold blameless and free of all accusation of such force or coercion Wild MurrayMemories.com his legal representatives, assigns, and those acting under his permission.

Conflict of Laws

This Agreement shall be governed by, and construed in accordance with, the laws of the United States, and to the extent not preempted, the substantive laws of Colorado. Should any provision of this Agreement be declared or determined to be invalid or illegal, the validity of the remaining provisions shall not be affected, and the invalid or illegal provision shall be deemed not to be a part of this Agreement. MurrayMemories.com and Model further state that they have carefully read the foregoing Agreement and know the contents thereof, they sign the same as their own free act, and that they are empowered and authorized to bind themselves and/or their principals to the terms of this Agreement.

Infringement. In the event of an infringement of the Work, the Photographer and MurrayMemories.com shall have the right to sue for the infringement or at photographers discretion request a fee of $1000 per incident due immediately upon request. There will be no time limit for enforcement of this section of the contract.

THIS IS NOT A CONTRACT OR AGREEMENT FOR WORK FOR HIRE. THE IMAGES ARE NOT THE PRODUCT OF A WORK FOR HIRE. 

Age of Majority

Model hereby affirms that they are over 18 and that Model is fully able to contract in his/her own name without breach of any prior agreement or applicable law, including but not limited to prior agreements with modeling and talent agencies.

I have read the foregoing prior to its execution and I am fully familiar with and agree to the contents thereof
